Agreement to Terms
By accessing or using the services of ValueCode Appraisals Inc. ("Company," "we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
Services Provided
ValueCode Appraisals Inc. provides professional real estate appraisal services for residential properties in British Columbia. Our appraisals are conducted in accordance with the Canadian Uniform Standards of Professional Appraisal Practice (CUSPAP) and applicable provincial regulations.
Client Responsibilities
When engaging our services, you agree to:
- Provide accurate and complete information about the property
- Grant reasonable access to the property for inspection purposes
- Pay all fees and charges in accordance with our fee schedule
- Use the appraisal report only for its intended purpose
- Not alter, modify, or reproduce the appraisal report without written consent
Fees and Payment
Fees for appraisal services are determined based on property type, complexity, and turnaround time. Payment is typically required before the final report is delivered. Rush service requests may incur additional fees. All fees are quoted in Canadian dollars and are subject to applicable taxes.
Cancellation and Refunds
Cancellations must be made in writing. If you cancel after the property inspection has been completed, you may be charged for work performed. Refund policies will be determined on a case-by-case basis depending on the stage of the appraisal process.
Appraisal Report Use and Limitations
The appraisal report is prepared for the specific intended use and intended user(s) identified in the report. The report:
- Represents our professional opinion of value as of the effective date
- Is based on information available at the time of the appraisal
- Should not be used for purposes other than those stated in the report
- May not be valid for use after a certain period due to market changes
- Remains the property of ValueCode Appraisals Inc. unless otherwise agreed
Professional Standards and Liability
Our appraisers are designated members of the Appraisal Institute of Canada and adhere to CUSPAP standards. We maintain professional liability insurance as required by our professional association. Our liability is limited to the fee paid for the appraisal service, except where prohibited by law.
Confidentiality
We maintain the confidentiality of client information and appraisal reports in accordance with professional standards and applicable privacy laws. We will not disclose your information or appraisal report to third parties without your consent, except as required by law or professional obligations.
Intellectual Property
All content on our website, including text, graphics, logos, and software, is the property of ValueCode Appraisals Inc. and is protected by Canadian and international copyright laws. You may not reproduce, distribute, or create derivative works without our written permission.
Limitation of Liability
To the maximum extent permitted by law, ValueCode Appraisals Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services or website. Our total liability shall not exceed the amount paid for the specific appraisal service.
Dispute Resolution
Any disputes arising from these Terms of Service or our services shall be governed by the laws of British Columbia and Canada. Disputes shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes may be submitted to mediation or arbitration before pursuing litigation.
Changes to Terms
We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after changes constitutes acceptance of the modified terms.
